Terms of Service

1. Who We Are

Pastaio (“Pastaio,” “we,” “us,” or “our”) is operated by Mekumek LLC, a limited liability company organized under the laws of the State of California (“Company”). These Terms of Service (“Terms”) govern your access to and use of the Pastaio website, application, and related services (collectively, the “Service”).

2. Acceptance of Terms

By creating an account, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.

3. Eligibility

You must be at least 13 years old to use the Service. If you are between 13 and 18 years old (or the age of majority in your jurisdiction, if higher), you may only use the Service with the involvement and consent of a parent or legal guardian, and that parent or guardian agrees to be bound by these Terms on your behalf where applicable. You must also be of legal age to form a binding contract in your jurisdiction to make any purchase through the Service. By using the Service, you represent that you meet these requirements.

4. Your Account

To use the Service, you must sign in using a Google account. You are responsible for:

  • Maintaining the confidentiality and security of your account;
  • All activity that occurs under your account;
  • Providing accurate information during sign-in.

You must notify us immediately at knyazjr@gmail.com of any unauthorized use of your account.

5. Credits and Payment

  • The Service operates on a credit-based system. Credits are purchased through our payment processor (Stripe) and consumed when you generate content.
  • All sales are final. We do not offer refunds for purchased credits except as described below.
  • Automatic refund on any failed generation: If a generation request fails for any reason — including a technical error on our end or on the part of our underlying AI providers, a request timing out, or a request being blocked by automated content-safety filters (see Section 7) — the credits charged for that specific request are automatically refunded to your account. We only charge you for generations that actually produce output.
  • We reserve the right to change credit pricing at any time. Changes will not affect credits you have already purchased.
  • We do not store your payment card information. All payment processing is handled directly by Stripe, subject to Stripe’s own terms and privacy policy.

6. The Service and Third-Party AI Providers

Pastaio is a platform that lets you generate video, image, and audio content using third-party AI models (including but not limited to Google Veo, Kling, and Seedance), accessed through third-party infrastructure providers. This means:

  • Generation results are produced by third-party AI systems we do not own or fully control. We do not guarantee the accuracy, quality, appropriateness, or availability of any generated output.
  • Generation requests may be reviewed by automated safety filters (ours and/or our providers’) and may be blocked if they are flagged as violating content policies — including requests involving copyrighted characters, real identifiable people without consent, or other restricted content.
  • We do not offer or knowingly provide access to models intended to generate sexually explicit (“adult”) content, and we do not intend to add such capability.
  • Service availability, generation speed, and feature availability may change based on changes made by our third-party AI providers, which are outside our control.

7. Acceptable Use Policy

You agree not to use the Service to generate, upload, or distribute content that:

  • Depicts, facilitates, or promotes child sexual abuse material (CSAM) in any form. We report any such content to the National Center for Missing and Exploited Children (NCMEC) and will immediately and permanently suspend associated accounts.
  • Depicts a real, identifiable person without their consent, including in a sexual, defamatory, or otherwise harmful context (e.g., non-consensual “deepfake” content).
  • Infringes the intellectual property, publicity, or privacy rights of any third party, including using copyrighted characters or trademarked content without authorization.
  • Is sexually explicit, obscene, or pornographic.
  • Promotes, threatens, or depicts violence, self-harm, terrorism, or other illegal acts.
  • Harasses, defames, or discriminates against any individual or group.
  • Violates any applicable law.

We use a combination of automated systems and, where necessary, manual review to enforce this policy. We reserve the right to suspend or terminate your account, without refund of remaining credits, for any violation of this policy.

8. Your Content

  • You own the content you generate, subject to the underlying rights of any third-party AI provider and applicable law, and subject to your compliance with these Terms.
  • You grant us a limited, non-exclusive license to store, process, and display your generated content solely as necessary to operate and provide the Service to you (e.g., displaying it in your account history/gallery).
  • Your generated content is private to your account. It is stored only in your own account history/gallery and is not shown to other users or made public by us.
  • You are solely responsible for the prompts you submit and the content you generate, and for ensuring you have the right to use any input (e.g., uploaded reference images).

9. Intellectual Property

The Service, including its design, branding, and underlying software (excluding your generated content and third-party AI model outputs), is owned by the Company and protected by intellectual property laws. You may not copy, modify, or reverse-engineer any part of the Service except as permitted by law.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, including for violation of these Terms. You may stop using the Service and delete your account at any time by contacting us at knyazjr@gmail.com.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT GENERATED CONTENT WILL MEET YOUR EXPECTATIONS.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify and hold the Company harmless from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

14. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. Any disputes shall be resolved in the state or federal courts located in California.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes (e.g., via email or a notice on the Service). Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
